Rancid

After receiving a message on Facebook from the 'People against Sri Ram Sena and Pramod Muthalik' group that I had joined, asking members to refrain from writing anything that might be deemed defamatory on the wall of the group, in wake of a 'recent Supreme Court ruling', I decided to check what the fuss was about. After all, wasn't the whole point of creating the said group, criticism of the party in question? I looked up TOI, and realized this is what the message was referring to.

Reacting to these posts, the Shiv Sena youth wing's state secretary registered a criminal complaint at Thane police station in August 2008 based on which FIR was registered against Ajith under Sections 506 and 295A pertaining to hurting public sentiment.
Starting an anti Shiv Sena community on Orkut = hurting public sentiment??!!! Since when? Like the Shiv Sena echoes public sentiment and the public unanimously and unequivocally supports the Shiv Sena.

I am not going to write about how this is blatant stifling of the freedom of expression. Most comments on the article echo my exact sentiments. And it makes me ponder over the ridiculousness of the decision. Is this what has become of justice in India?

Here, you will find hate communities for anyone and anything that has ever existed, more so public figures and political parties - George W. Bush, Barack Obama, Shah Rukh Khan, Slumdog Millionaire, toilet paper, Amitabh Bachchan, herpes, gay people. Heck! There might be a hate community about me out there somewhere that I am unaware of, created by 16 year girls discussing the most excruciating ways by which I must be put to death because I said 'Twilight' did not impress me much. Surely, a hate mongering party that thrives on divisive politics might expect to find one that criticizes them? Or is public criticism of anything a crime now? Or is that just restricted to criticism of big goons? Starting an orkut community calls for a court trial? How about I make a movie that criticizes and ridicules the government, like Michael Moore? Would that warrant a death sentence? If tards like the complainant in this case, go BAWWWWWW!!! over anything that has ever been written against them, are you going to have us all arrested and appear before you in court? Are most of the commentators on the TOI article criminals? Will you be charging them with disrespecting the court decision?

I'll tell you what. I implore everybody reading this to stand up against this atrocious decision and put up the most provocative, defaming, ridiculing post or opinion that these tards deserve on your blogs. Or start more hate communities. Let us send out a message - If you are in the public arena, be ready to face the heat or bow the fuck out. People will have opinions about you. Some might praise you. Others will not be so generous. Some might be polite. Others will disembowel you outright for what it is worth. Let us do this, and let us see how many of us they can stop from speaking our minds out in public. Let us deny these bullies the one thing they survive on - our fear. When you are a major political party and have to complain when a 19 year old starts an orkut community that criticizes you, you prove to be the wussies we already know you are.

Balakrishnan and Sathasivam, you have made a laughable, ludicrous, unjust and unconstitutional decision. One that tramples on citizens' fundamental right to freedom of expression. And as an ironic consequence, you should expect hate communities about you and infinite ridicule hurled your way. You have brought India's judicial system to shame, and in the process made yourselves look like morons with heads up your asses.

There! Hah! I just publicly humiliated you. To any tards reading this, go ahead and flag my blog. Or try to have me arrested. Send me a summons. Slap provocation and defamation charges against my butt. Do the only thing you are good at - bullying. I want to see just how far you can go to smother free speech.

I agree with your view. Criticism is something people have to accept as part of being in the public arena. As long as it has do with their public lives, we have every right to say what we want. I shall come up with an explosive post soon.

If the courts get away with this, it will be a terrible travesty of justice and a dangerous precedent. The Internet has opened up a whole new virtual world that needs regulation according to the 'gyaanis' that we seem to have in surplus in India. I cannot say I disagree with them entirely - yes some stuff needs policing - mostly to keep children online safe from lurking offenders etc - but this is just Bull!!!
Am I mistaken in assuming that the Indian constitution guarantees the right to FREE SPEECH??? Maybe it's coz Orkut is involved again - like they have been in that guy whose friends kidnapped and killed him...even so...hauled to court for expressing an opinion in the world's biggest democracy...might as well declare Martial Law!

you seem to have got court's verdict all wrong...Court in this case din't rule in favor of Shiv Sena...it just made a statement that person writin an online blog has to face the consequences of doing so, just like any other written or visual media. I don't see anything wrong in court's argument. If you can file such case against printed media, why exempt blogger community from the same...

No matter where you air your views, you are answerable to whatever you write or say...

Shiv Sena's claim that this community has hurt public statements etc. is hilarious though..

The courts havent ruled that Shiv Sena is correct in what it does, only that you cant always hide behind a disclaimer label.

Lets not jump the gun here.
What happens after he is taken to court is what we should be looking at.

I think we have more important backlogs of cases to take care of than looking at Shiv Sena's concerns, who has no business other than finding ways to be in news. They have no mission of improving any systems or do any benefits to the locals. I think the entire nation should file case against him, like 1000 FIRs against him saying he has hurt country's sentiments by saying provocative statements in his speeches. I think we should remove such bastards from the mainstream and going back to blogging, it is impossible to have a rule which can stop us from expressing our opinions.

You know zilch about me or my history. You don't know if I belong to a Hindu or Muslim or Jewish family. So stop making random stabs in the dark about my background. I respect a person's right to believe in whichever deity they want, just as I respect their right to believe that they have the best parents or the best spouse or the most beautiful children in the world. I myself wouldn't believe it, but I won't question them over it as long as it remains a personal thing. The problem arises when religion no longer remains personal and people use it to further a political agenda or influence social outcomes in a secular nation. Every objection to the decriminalization of homosexuality is religious. One guy on a similar TOI blog commented that if he was given a pistol with 10 bullets, he would pick and kill 10 gay people; not 10 corrupt people, not 10 murderers or rapists, but 10 gay people. Such unadulterated hatred, almost to the point of being homicidal, for what? Thus arises a situation when the bubble bursts and patience can no longer work. If you ask me to 'respect' the guy's views in this case, you are actually asking me to respect his urge to kill 10 innocent people because they have a sexual orientation that is different from his. People will always have different opinions, and I would defend the right of a person to have an opinion that is diametrically opposite to mine, even if I oppose the opinion itself. Some people can be educated in matters like this and reasoned with. Others not so much.
Please refrain from double, triple, quadruple and quintuple posting of comments.

i really understand u ,ur thought as being educated and part of free world,but in same time let me tell u the man with the pistol might have replied in context to some discussion relating to homosexuality which he certainly is against ,if they were discussing theft or crime,i m more than certain he would be last person to think about homosexual activity.and would have said the same against theifs ,i m not making random stabs ur are aseem sudhir nevrekar from religious marathi hindu family hometown mumbai in usa since 2005 studing in Oklahoma university doing phd,done engineering from Mumbai president of some student organisation in university of Oklahoma self proclaimed atheist,without resistance from parents

Religion is simply a failed attempt at explaining things in a way that we now know to be extremely unscientific, unreliable, childish and downright silly. And the moment it enables one to fly planes into buildings or amass mobs to destroy a centuries old Mosque, it has outstayed its welcome and it's time for religion to go bye-bye.

well u may also have suffered in hands of religion too,everything has pros and cons,even when u say science ,does it mean that scientific progress is without any ill effect ,today there are more medicines than yesterday so are diseases ,the airplanes u mentioned crashed in buildings but what about normal aircrash of airfrance did it involve any religion ,do u stop making planes or travelling because the airfrance plane crashed.
a mob destroyed a mosque ,because they believed in something ,so was the attack on iraq where usa believed in something
just because some incidents happen doesn't mean the system is at fault
even the most powerful nation says "in god we trust"
because even their constitution is not fool proof simply because we are not GOD ,and even HE makes mistakes
u amend constitutions and laws at regular intervals in accordance w ur and society needs ,and don't say that u don't trust the system and say bye bye to it, in same way many wrongs in religion has to be changed and not totally discarded.

Dude! This might be news to you, but I have a life beyond this blog. I am a student, teacher, researcher, traveler, son, friend, colleague and a horde of other things apart from being a blogger. So, no matter when I read your comments, I'll reply when I want to and when I have the time. I want you to understand this.
Also, as for making knee-jerk predictions about me not replying and deleting comments and then feeling triumphant when I don't reply for a few days, like I said before, you don't know squat about me to be making predictions about what I will or will not do, but at least, you can bear in mind that you were linked to my blog via my comment on a TOI op-ed piece. The link existed because I put it there. That alone should tell you that I wanted people to contact me through my blog. I invite and often welcome views opposing mine; I like debates and discussions. If I didn't, I wouldn't have embedded a link to my blog within my ID on the TOI comments page. Also, if you've noticed, I haven't enabled comment moderation on my blog. You can write what you want, and my blog won't so much as ask for a word verification. If I believed in censoring my critics, I would peruse their comments first before deciding whether I should let them show on my blog. Case in point, you, a complete stranger to me, popped up out of the blue and began to cuss at me on my own blog. If I wanted to shut you up, your comments would not have made it here at all. But I haven't done anything of the sort. All your comments are still here for everybody to read, annoying multiple posts included. So, before you start making ad hominem predictions like you've done above, consider this before you fall flat on your face. I would delete your comments only in two cases: 1. If you are a spammer or 2. if you are a troll posting here with the sole purpose of picking a fight with me for the sake of it, which brings me to JK (see my next comment)

I let you comment freely on my past posts. I was getting the feeling you were picking an argument for the sake of arguing, but I still gave you the benefit of the doubt, but your comment above seals it for me. And the one kind of people that I cannot stand and will not allow to post on my blog, are liars, doesn't matter if they are theists or atheists. You say, and I quote, 'these highly educated persons think all other people and their views are stupid', obviously referring to me, since this is my blog, and since Saras' comments were addressed directly to me. Point out to me, JK, any statement anywhere on this blog, where I state that all religious people are stupid. If you have alleged something, back up your accusation with evidence. Go through the posts on my blog that speak against organized religion, and point out, where, among other things, I claim that all believers/theists are stupid. My family has believers. They are not stupid. Some of my best friends are religious, and they are highly intelligent. Some of the brightest people I know are believers. Sure I am an atheist and an anti-theist, and my political, philosophical and sometimes moral positions do not agree with the positions of these people I just mentioned, but I won't call these people stupid. Some religious people can indeed be stupid, as can some atheists. I do not use belief or disbelief in a deity as a parameter to gauge someone's stupidity. So, JK, go on. Scour my blog and come up one statement, just one, where I call all religious people stupid. I give you a week from now. You have till August 7, 2009. If you succeed, well and good.
